Luxury CBD Stay Pty Ltd (ACN: 696969089, ABN: 46696969089) operates as a short-term rental accommodation provider. We lease properties from property owners under formal lease agreements and sublease them to verified guests for short-term stays.

Our properties are listed and booked primarily through Airbnb, and all bookings are subject to both these Terms of Service and Airbnb's Terms of Service.

2. Acceptance of Terms

By accessing our website or making a booking with Luxury CBD Stay, you agree to be bound by these Terms of Service, our Privacy Policy, House Rules, and Guest Policies. If you do not agree to these terms, please do not use our services.

3. Booking and Payment

3.1 Booking Process

All bookings are made through Airbnb. By completing a booking, you enter into a binding agreement for the accommodation services described in the listing.

3.2 Payment

• All payments are processed securely through Airbnb's payment system
• Total payment includes nightly rate, cleaning fee, and applicable service fees
• A security deposit may be required for certain properties
• Payment is due at the time of booking confirmation

3.3 Payment Security

All transactions are encrypted and processed through Airbnb's secure payment platform. We do not store credit card details on our systems.

4. Cancellation and Refund Policy

Our cancellation policy follows Airbnb's guidelines. The specific policy applicable to your booking will be displayed on the listing page before you confirm your reservation.

4.1 Guest Cancellations

• Flexible: Full refund if cancelled 24 hours before check-in
• Moderate: Full refund if cancelled 5 days before check-in
• Strict: 50% refund if cancelled 7 days before check-in

The applicable policy will be clearly stated on each listing. Airbnb service fees may be non-refundable.

4.2 Host Cancellations

In the rare event we need to cancel your booking, you will receive a full refund and we will assist in finding alternative accommodation where possible.

5. Guest Responsibilities

As a guest, you agree to:

• Provide accurate personal information and valid identification
• Comply with our House Rules at all times
• Treat the property with care and respect
• Not exceed the maximum number of guests specified in your booking
• Report any damages or issues promptly
• Vacate the property by the agreed check-out time
• Not engage in any illegal activities on the premises

6. Damages and Security Deposit

You are responsible for any damage caused to the property or its contents during your stay (excluding normal wear and tear). Damages may be charged against:

• The security deposit (if applicable)
• Airbnb's damage protection program
• Direct billing to the guest for costs exceeding the deposit

7. Consumer Guarantees

Under Australian Consumer Law, you are entitled to certain consumer guarantees that cannot be excluded. Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures, you are entitled to:

• Cancel your booking and receive a refund
• Compensation for any reasonably foreseeable loss or damage

For minor failures, we are entitled to provide you with a remedy within a reasonable time. If we fail to do so, you may have the service provided elsewhere and recover reasonable costs from us.

8. Limitation of Liability

To the maximum extent permitted by law:

• We are not liable for any indirect, incidental, or consequential damages
• Our total liability shall not exceed the amount paid for your booking
• We are not responsible for loss or damage to personal belongings unless caused by our negligence
• We are not liable for interruptions to utilities or services beyond our control

All content on our website, including text, images, logos, and design elements, is the property of Luxury CBD Stay Pty Ltd and is protected by copyright law. You may not reproduce, distribute, or use any content without our written permission.

• Property images represent current exact conditions

11. Governing Law
